City of Sydney Planning Updates September 2026: Waste & Loading DCP, Open Exhibitions and Heritage Watches
giantA Pty Ltd, Franz Phan

The most actionable City of Sydney change for small residential and mixed-use DAs in late 2026 is the adopted Loading and Waste Collection amendment to Sydney DCP 2012 (Council 24 August 2026; comes into effect two weeks after that resolution — confirm the calendar date on the City DCP page before lodgement). Several heritage and CBD LEP items are approved for making but not verified as published on legislation.nsw.gov.au in this pass. Two consultations are open now: a Redfern heritage-boundary proposal and an Alexandria Green Square VPA.

Loading and Waste Collection DCP (adopted — confirm commencement)

On 24 August 2026, Council approved the post-exhibition Sydney DCP 2012 — Loading and Waste Collection package, completing provisions deferred when the Policy and Housekeeping LEP/DCP update was approved on 23 June 2025 (original exhibition 17 December 2024 – 14 March 2025). Council also approved updated Guidelines for waste management in new developments.

Per the resolution, the Guidelines and DCP amendment come into effect two weeks from the date of the Resolution of Council (from 24 August 2026). Confirm the published effective date on the Sydney DCP 2012 page and adopted PDF before lodging — do not invent a calendar day. Decision: ID 6792; report: Loading and Waste Collection PDF.

Quoteable design facts (no invented clause numbers):

  1. Designs calibrate to Council’s waste fleet: a 10.6 m truck (updated from the previous 9.25 m reference).
  2. Alternatives for constrained sites: kerbside collection for residential up to 6 dwellings or non-residential up to 200 sqm; local-centres retail exception to avoid new driveway crossings on shopping streets.
  3. “Wheel out and wheel in” for residential up to 90 dwellings in certain circumstances, plus a process to agree alternatives with City staff even when the City is not the consent authority.
  4. Updated waste-management guidelines sit beside the DCP — pull both for student housing / co-living generation-rate conversations.

This is the highest LGA-wide control shift in this digest. It bites basement swept paths, loading docks, bin rooms and street-collection assumptions — especially ≤6 dwellings, local-centre retail, and mid-rise apartments weighing wheel-out. giantA practice: flag Loading and Waste early on any live CoS DA or pre-lodgement advice from early September 2026, and re-check the DCP hub for the confirmed commencement date before issuing drawings as compliant. For coordinated architectural services and DA documentation, treat waste/loading as a first-pass constraint.

Site-specific Green Square VPA example — useful negotiation context, not an LGA-wide contributions-rate change.

Heritage watches (approved for making — confirm gazettal)

Oxford Street LGBTIQA+ Heritage Items (Stage 2)

Status: APPROVED FOR MAKING — CSPC 25 June 2026; Council 29 June 2026. Comes into effect when published on the NSW legislation website. Publication not verified in this research pass — do not assume Schedule 5 listing is live. Sources: CSPC AIId 21856; Council ID 6716.

Lists three sites in Sydney LEP 2012 Schedule 5: Former Ruby Reds, 273 Crown Street, Surry Hills; Former Taxi Club, 40–42 Flinders Street, Darlinghurst; Former The Bookshop, 207 Oxford Street, Darlinghurst. Exhibition (31 March – 5 May 2026) received 17 submissions; inventory sheets clarified after exhibition with no changes to the PP itself. Approved to be made as an LEP under s3.36 EP&A Act. Soft claim only until legislation.nsw.gov.au confirms publication.

Modern RFB heritage (Potts Point / Elizabeth Bay / Rushcutters Bay)

Status: APPROVED FOR MAKING — CSPC 17 September 2026 approved an amended PP to be made as an LEP under s3.36. Gazettal not verified. City page: Proposal to heritage-list modern apartment buildings; CSPC: ID 6837.

Caution on list size: the City page describes nine post-war (1945–1975) apartment buildings; CSPC’s amended package includes revised inventories for eight of the named buildings — whether every City-page building remains is not confirmed from the decision page alone. giantA describes the watch-list as several post-war RFBs in Potts Point / Elizabeth Bay / Rushcutters Bay, and directs readers to the City page and CSPC attachments rather than publishing a definitive named list. Confirm the final item list and legislation.nsw.gov.au publication before advising.

Major CBD / Newtown proposals (site-specific — not suburb-wide)

King Street Special Entertainment Precinct (Newtown). Joint City of Sydney / Inner West package amending Sydney LEP 2012, Sydney DCP 2012 and a precinct management plan. CSPC approved for Gateway and exhibition 25 June 2026; Council 29 June 2026. Draft timeline targeted Gateway / exhibition in Q3 2026, but live Have-your-say dates were not confirmed at 21 September 2026 research. A broader City-wide SEP PP was still described as awaiting Gateway. Do not treat King Street SEP or a City-wide SEP as operative. Sources: CSPC AIId 21854; Council ID 6718.

Piccadilly Centre — 133–145 Castlereagh Street. Approved for Gateway + exhibition (CSPC 25 Jun / Council 29 Jun 2026). Two options (commercial; mixed-use with residential capped) retaining/upcycling the Castlereagh Street tower and addressing the Hyde Park Sun Access Plane. Exhibition timing subject to Gateway — dates not confirmed on a live consultation page in this pass. Site-specific only. Source: CSPC AIId 21855.

580 George Street. Council approved for making 24 August 2026 (FSR to 15.1:1, about 8,000 sqm additional employment floor space; no height change). Publication on legislation.nsw.gov.au not verified. City: 580 George Street; decision ID 6790.

150 Day Street (hotel uplift). Council approved 24 August 2026 to send to DPHI; Portal records return for assessment and drafting on 27 August 2026 (Finalisation, PP-2025-550). Height about 45 m to about 85 m / RL 87.7 m and FSR 9.9:1 to 13.5:1 are on the City page and Portal — not live until LEP publication. Portal: 150 Day Street; City: 150 Day Street; decision ID 6791.

State context (brief)

From 1 July 2026, the section 9.1 Local Plan Making Direction applies to planning proposals lodged on the NSW Planning Portal on or after that date. The LEP Making Guideline (July 2026) sets modules, standard vs complex categories, and benchmark working-day timeframes. City of Sydney is listed among Metropolitan NSW councils; the IPC handles rezoning and Gateway reviews for the City. Soft claim: this mainly affects proponent-led rezoning evidence and timelines, not every house DA. Sources: Making and amending LEPs; Guideline PDF; s9.1 Direction PDF.

Practical next steps for giantA clients

  1. On any CoS DA or pre-lodgement package, check Loading and Waste early (10.6 m truck, kerbside / wheel-out thresholds, Guidelines), then confirm the DCP commencement date on the City hub.
  2. If near Redfern George Street or Alexandria Botany Road, lodge comments before the close dates above.
  3. For Oxford Street Stage 2 and Modern RFB heritage, watch gazettal on legislation.nsw.gov.au — do not redesign on “approved for making” alone.
  4. Do not redesign King Street trading hours or City-wide SEP assumptions as if already operative.
  5. Assemble the matching document pack: Statement of Environmental Effects, heritage SOHI where triggered, and architectural / DA documentation.

  7. Soft CTA: request a review with giantA — no invented lodgement timelines.

FAQs

What City of Sydney planning change most affects small residential DAs in late 2026?

Council adopted Loading and Waste Collection DCP amendments on 24 August 2026 (10.6 m truck design, kerbside limits for ≤6 dwellings / ≤200 sqm non-residential, and wheel-out options up to 90 dwellings in certain circumstances), with commencement two weeks after that resolution. Confirm the exact commencement calendar date on the Sydney DCP 2012 page before relying on it for lodgement.

Are the Oxford Street Stage 2 or Modern RFB heritage listings live yet?

Not on the strength of “approved for making” alone. Both have Council/CSPC approval pathways to be made as LEPs, but this digest did not verify publication on legislation.nsw.gov.au. Treat them as heritage watches until the amending instrument is published, then re-check section 10.7 and Portal maps.

Is the King Street Special Entertainment Precinct operative?

No. CSPC and Council approved a Gateway and exhibition pathway in late June 2026; live exhibition dates were not confirmed at 21 September 2026 research. Do not claim King Street SEP or a City-wide SEP has commenced.

Next step: Request a City of Sydney DA design review with giantA — architectural services and approvals documentation for homes and small developments across Greater Sydney.
