What Heritage & Conservation Design Covers

Heritage design in NSW spans three overlapping frameworks, each with different controls, assessment pathways and approval authorities:

  • Heritage-listed properties — items on the NSW State Heritage Register or a council’s Local Environmental Plan (LEP) heritage schedule. Works require a Heritage Impact Statement and, for state-listed items, Heritage Council of NSW consultation under the Heritage Act 1977 (Section 60 / Section 140 permits).
  • Heritage Conservation Areas (HCAs) — streetscapes and precincts protected as a whole. Most Sydney inner-ring suburbs have HCAs covering entire neighbourhoods. Any external alteration visible from the public realm typically requires consent.
  • Contributory items — individual buildings within an HCA that contribute to its character. These carry stricter controls than non-contributory (neutral or detracting) buildings.
  • Adaptive reuse — conversion of heritage buildings to new uses: warehouse to office or residential, church to community space or home, pub to boutique hotel, civic buildings to galleries. Adaptive reuse often needs both heritage approval and a change of use under the NCC.

All fees exclude GST and council/certifier fees. State-listed (SHR) projects attract a Heritage Council permit fee in addition. Fixed-fee proposal issued after the free heritage assessment.

Do I need a Heritage Impact Statement for my renovation?

Yes, for any heritage-listed property or contributory item in an HCA where works affect heritage significance. The HIS is a structured assessment of how the proposal affects the heritage significance of the item or area. It must be prepared by a qualified heritage practitioner. We prepare HIS in-house as part of our DA package — you don’t need a separate consultant.

Can I add a modern extension to a heritage-listed home?

Usually yes, provided the addition is sympathetic — typically set behind the main heritage form, uses a contrasting but recessive material palette, and doesn’t dominate the original building. Contemporary additions are often easier to approve than faux-heritage replications because they maintain a clear distinction between old and new (the Burra Charter principle).

What’s the difference between a heritage-listed property and a conservation area?

A heritage-listed property is an individually recognised item with statutory protection. A Heritage Conservation Area (HCA) is a precinct-level control that protects the collective character of a streetscape — most houses in an HCA are not individually listed but still carry controls. How long does heritage DA approval take in Sydney?

Typical heritage DA assessment is 12–24 weeks — about 4–6 weeks longer than a standard DA because of the internal heritage referral. State Heritage Register properties may take longer due to Heritage Council consultation. Pre-DA heritage meetings, which we arrange routinely, can trim assessment time considerably by resolving approach issues before lodgement.

Can I convert a warehouse or church into a residential home or office?

Yes — this is called adaptive reuse and it’s a specialty. It usually requires a change of use under the NCC (e.g. Class 5/7 to Class 1a or Class 2), a heritage impact assessment, retention of significant fabric, and upgraded fire, accessibility and energy compliance. We’ve handled warehouse-to-residential, church-to-community, and pub-to-boutique-hotel conversions across Sydney.

Do heritage homes need BASIX and NatHERS?

Yes — heritage listing does not exempt a residential project from BASIX and NatHERS. However, heritage-appropriate solutions are recognised: secondary glazing rather than replacement windows, sympathetic insulation systems, and solar panels sited away from the principal facade.
