Class 6 is the NCC building classification for premises where goods are sold by retail or where food and drink are served to the public. Understanding whether your project is Class 6 determines the approval pathway, accessibility standards and fire safety provisions that apply.
Class 6 covers:
- Shops — retail stores, showrooms, display suites, service-station retail
- Cafes, restaurants and bars — any premises serving food or drink for consumption on-site
- Service retail — hair and beauty salons, laundries and dry-cleaners, real estate agencies, bank branches
- Food premises — anywhere food is prepared, stored or sold to the public (these attract additional NSW Food Authority registration)

What is an NCC Class 6 building?
Class 6 covers premises where goods are sold by retail or where food and drink are served to the public: shops, cafes, restaurants, showrooms, service-station retail, hair and beauty salons, laundries, dry-cleaners and bank branches. It excludes medical (Class 9a), childcare (Class 9b) and offices (Class 5).
What's the difference between Class 5 and Class 6 in the NCC?
Class 5 is office buildings used for professional or administrative work. Class 6 is retail premises where goods are sold by retail or food/drink is served to the public. The distinction matters because Class 6 triggers additional requirements for public toilet facilities, food-premises design (if applicable), and often more stringent accessibility provisions. A bank branch with customer-facing retail is Class 6; a law firm office is Class 5 — even in the same building.
Do I need a DA to convert a house to a shop or cafe?
Yes, in almost all cases. Even where the existing use is lawful, changing from Class 1a (single dwelling) to Class 6 (retail) is a change of use requiring DA approval, plus upgrades to commercial accessibility, fire safety and public toilet standards. We assess the feasibility (zoning, parking, heritage) before recommending you proceed.
What approvals do I need beyond the DA to open a food premises?
In addition to DA approval, food premises need: NSW Food Authority registration (via your local council), kitchen exhaust ventilation to AS/NZS 1668.2 compliance, hydraulic design to meet trade waste requirements, and HACCP-aligned food premises layout (AS 4674). Liquor licensing (if applicable) is a separate NSW Liquor & Gaming NSW application. We coordinate these as part of the design package — the documentation overlaps substantially.
How long does a Class 6 DA approval take in Sydney?
Change-of-use DA: 6–12 weeks. New retail building: 4–6 months. Retail in heritage conservation areas or mixed-use precincts: 6–12 months because of additional heritage or urban design referral. Pre-lodgement meetings usually trim 4–8 weeks off these timelines and we recommend them for any non-trivial Class 6 project.
Do I need a separate approval for outdoor dining?
Yes. Even with DA approval for the premises, tables and chairs on the footpath or road reserve require a Footpath Usage Permit (sometimes called a ‘pavement licence’) from your local council. This is a separate application with its own fee, public liability insurance requirement (typically $5–20M), minimum clear pedestrian path (1.5–2 m) and signage rules.
